These Terms of Service apply to purchases made through the wasted hour online store. Please read them carefully before placing an order.

1. Seller and scope

These Terms apply to contracts for goods offered through our online store. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person, or a partnership with legal capacity, acting for purposes relating to their trade, business or profession.

2. Products and conclusion of the contract

Product presentations in the online store do not constitute binding offers. By completing the checkout and clicking the final order button, you submit a binding offer to purchase the items in your cart.

We may accept your offer within five days by sending an express order confirmation, requesting or processing payment, or dispatching the goods. The first of these events determines when the contract is concluded. An automatically generated confirmation that we have received your order does not by itself constitute acceptance unless it expressly confirms acceptance.

Before submitting your order, you can review and correct the information entered during checkout. The contract information and these Terms can be saved or printed. We also send the relevant order information to the email address supplied during checkout.

The language available for concluding the contract is English.

3. Prices and payment

All prices displayed in the online store are total prices in euros and include applicable VAT. Shipping costs are shown separately before the order is submitted.

The payment methods available for an order are displayed at checkout. Payments are processed by the payment provider selected by the customer and are subject to that provider's applicable conditions. We may withhold dispatch until payment has been successfully authorised or received.

4. Delivery and store collection

We currently deliver only to Germany and the other member states of the European Union. The available destinations, shipping costs, free shipping thresholds and estimated delivery times are set out in our Shipping Policy and are confirmed during checkout.

Goods are delivered to the address provided during checkout. Please ensure that the delivery information is complete and correct. If delivery fails for reasons attributable to the customer, we may charge the reasonable additional costs incurred, without affecting the customer's statutory rights.

Free collection from wasted hour - concept store, Neuer Wall 88, 20354 Hamburg, Germany, may be selected when available at checkout. Please wait for our collection confirmation before visiting the store.

For consumers, the risk of accidental loss or damage passes when the goods are delivered to the consumer or to a third party designated by the consumer, other than the carrier.

5. Right of withdrawal, cancellations and returns

Consumers generally have a statutory right to withdraw from a distance contract within 14 days. Full information about the withdrawal period, the procedure, return costs and statutory exceptions is provided in our Return and Refund Policy.

To exercise the right of withdrawal electronically, request a cancellation before dispatch, or request a return after delivery, use our clearly accessible Withdraw from contract function. After entering your email address, you will receive a verification code and can select the relevant order and items. An electronic confirmation of the submitted request will be sent to you.

The electronic function is an additional way to exercise your statutory rights. Any other clear statement communicating your decision to withdraw remains possible in accordance with applicable law.

6. Retention of title

Goods remain our property until the purchase price has been paid in full.

7. Defects and statutory warranty

Statutory warranty rights apply. If goods arrive with visible transport damage, please notify the carrier where reasonably possible and contact us promptly. Failure to do so does not affect your statutory rights.

For an incorrect, damaged or defective item, contact cs@thewastedhour.com. Once the claim has been accepted, wasted hour bears the necessary return costs.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have expressly given a guarantee.

In cases of slight negligence, we are liable only for a breach of an essential contractual obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may ordinarily rely. In such cases, liability is limited to the foreseeable damage typical for the contract. Statutory liability that cannot legally be limited remains unaffected.

9. Applicable law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence.

10. Jurisdiction

Statutory rules on jurisdiction apply to consumers. If the customer is a merchant, a legal entity under public law, or a special fund under public law, Hamburg, Germany, is the exclusive place of jurisdiction for disputes arising from the contractual relationship, to the extent legally permitted.

11. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
